Things to think about while the divorce process is ongoing

Many people who file for divorce tend to think in terms of after the divorce. That is, one spouse may want the house, joint custody, use of one of the cars and perhaps spousal support for a few years. However, it is important to think in the short term as well. A lawyer can help you figure out what you need to stay afloat while the divorce is pending and what would be fair and reasonable to ask for. In fact, if you have been putting off filing for divorce because you are worried about how to support yourself in the short term, temporary orders may be able to help.

For sure, life can get complicated. Say that both cars are in your spouse's name, and in fact, were your spouse's before the marriage. Or you and your spouse share one car. How do you deal with these situations and others such as where to live and how to pay the bills?

Temporary orders

Your lawyer can file motions with the court for you to get a temporary order for use of a car, the house and other property. There can also be temporary orders for spousal support, child support and parental rights.

If you and your spouse have debts, temporary orders can also govern who pays what. This is important because in many cases, one spouse assumes that the other who has been in charge of the asset will just keep paying. This assumption can be particularly dangerous when the asset is in both spouses' names or in the name of the nonpaying spouse.

Do temporary orders become permanent?

It may be tempting to see temporary orders as a clue into what permanent orders are bound to look like. In fact, it can be natural to assume that temporary orders will become permanent after your divorce is official. However, there are often big changes between temporary and permanent orders as all of the parties in a case find out more information and plan for the long term.
