What Ohio’s Public Indecency Law Covers
Ohio Revised Code Section 2907.09 identifies the statutory charge as public indecency. Although people commonly use the phrase indecent exposure, the statute covers more than exposure alone. Its provisions vary based on the alleged conduct and who could view it.
The general provision addresses three categories of conduct:
- Recklessly exposing private parts
- Engaging in sexual conduct or masturbation
- Engaging in conduct that an ordinary observer would consider sexual conduct or masturbation
The circumstances must make the conduct likely to be viewed by and affront people outside the person’s household. Recklessness is a legal mental state involving disregard of a known risk, not simply an accusation that the conduct occurred.
A separate provision addresses knowingly engaging in masturbation, sexual activity, or apparently sexual activity when the conduct is likely to be viewed by and affront a minor. It applies when the minor isn’t the person’s spouse and is in the person’s physical proximity.
Potential Public Indecency Charges & Consequences
Charge levels depend on the alleged conduct, prior violations, and whether the accusation involves a minor. A first allegation involving exposure of private parts to an adult is generally prosecuted as a misdemeanor. Repeat violations and allegations involving sexual activity, masturbation, or a minor can raise the degree of the offense, potentially reaching a fifth-degree felony.
Certain cases involving a minor and a prior conviction can also result in Tier I sex offender or child-victim offender classification. That classification carries registration and verification duties in addition to consequences imposed in the criminal case. Because the applicable charge depends on the statutory provision and alleged facts, we examine the complaint or indictment before discussing the possible range of consequences.
How Public Indecency Cases Proceed in Miami County
A public indecency investigation can involve witness interviews, search warrants, and reviews of digital devices. We assess how law enforcement obtained evidence, what statements were made, and whether the available information supports each element of the alleged offense.
After a charge is filed, the process can include arraignment, bond conditions, and pretrial hearings. Miami County Municipal Court handles misdemeanor criminal matters and preliminary hearings in felony cases. The General Division of the Miami County Common Pleas Court has jurisdiction over felony criminal cases, so the court involved depends on the charge level and procedural stage.
Our attorneys guide clients through court appearances and negotiations with the Miami County Prosecutor’s Office. Depending on the circumstances, a case may proceed to motion practice, a plea, trial, dismissal, or another court disposition. We explain each stage so clients can make informed decisions as the case develops.
Defense Issues Under Ohio Revised Code Section 2907.09
A defense analysis begins by examining whether the alleged conduct fits the statutory definition. It also considers whether the evidence supports the applicable mental state, including recklessness under the general public indecency provision.
The surrounding circumstances matter. When the general provision applies, the evidence must support the claim that the conduct was likely to be viewed by and affront people outside the person’s household. Allegations involving a minor call for a separate examination of the statute’s relationship and household conditions.
Witness accounts, communications, recordings, digital evidence, and statements to law enforcement may affect that analysis. We review the available evidence in context rather than treating the allegation itself as proof.
